(1)保证金;定金 合同一方当事人向另一方当事人支付的用以保证合同履行的金钱,如其未能履行合同义务,该笔金钱则予没收。它也可最终成为部分付款,从而使买受人成为合同标的物的真正所有权人。 (2)(无偿)寄托;寄托物 指根据最初的信托目的而交付财物与受寄托人,由其无偿保管该财物。通常,由某人将其动产移转他人占有,后者负有为前者或第三人的利益而保管、使用、收益,或以种类物归还的义务。委托他人保管的财物即为寄托物。大陆法将该种寄托分成3种:1紧急寄托〔necessary deposit〕,也称灾害寄托〔miserable deposit〕,指在突发灾害事故时,未经充分和自由地选定受寄托人而仓猝将其财物交由他人保管;2任意寄托〔voluntary deposit〕,根据当事人之间的合意或协议而产生;3非任意寄托〔involuntary deposit〕,指未经寄托人同意而产生的寄托,例如某人的林木被洪水冲至他人土地上。普通法对前两种寄托不作区分。 (3)(法院的)讼争物寄托 指法院对未决诉讼的财产进行保管,直至有权占有该争议财产的人已予确定。 (4)储备;存款 1指一种行为,某人基于安全或便利的目的,将其金钱交由银行保管,并可由存款人随时或按事先约定支取该金钱;2指交由银行保管的金钱,或存款人由此而获得的债权。 (5)(矿产的)矿床;储量 v.
